By virtue of the Constitution of Australia, the Federal Government is responsible for dispute issues arising from parties to a marriage, including children and property. This takes place through the Family Law Act 1975 (“the Act”). The Act was somewhat revolutionary when introduced in 1975 as it abolished the concept of at fault divorce.
The main issues dealt with by the Act which concern you are Property and Children
1. Property – how the assets of the marriage will be divided between the parties.
2. Children - where and with whom the child/children will predominantly live and whom else they shall see and at what times and places and under what circumstances, bearing in mind that the ‘Interests of the Child’ are the predominant factor to be considered by a Court.
Please note that Divorce is where parties in effect terminate their marriage from a legal point of view. Separation is where the parties cease living together as a married couple. Please note that a separated couple may still reside in the same dwelling, or apart, and as the law is now drafted, undertake to enter into property settlement and care issues as regards children, irrespective of the fact they are not divorced. In short, Divorce is essentially a separate, almost administrative issue.
